Work Health and Safety Regulation in Australia explains how Australian work health and safety regulation seeks to meet the challenge of preventing work-related disease, injury and death. Written by two experts in the field, it is a current and practical resource for legal practitioners and students.
The book explains the origins of contemporary Australian work health and safety legal regulation, analyses the provisions of the work health and safety statutes; outlines practical issues, including potential difficulties in their application; and makes proposals for law reform. The Model Act, which seeks to harmonise work health and safety regulation in Australia, has been enacted by seven Australian jurisdictions, with an eighth adoption imminent. Not all the adopted WHS Acts are the same - each has provisions that deviate from the Model Act. Johnstone and Tooma provide a useful analysis of the provisions in the Acts that have adopted the Model Act, and the OHS legislation in Victoria which has not adopted the Model Act.
